Kogi varsity alumni drag VC to court over alleged N31m diversion

The Vice Chancellor of Prince Abubakar Audu University, Anyigba, Prof. Marietu Tenuche, has been dragged to court over the alleged diversion of N31 million meant for the alumni association of the institution.

At the first hearing on the suit filed at the Kogi State High Court, sitting in Anyigba, the plaintiff, Prince Audu Abubakar University Alumni Association, filed a motion of interlocutory injunction restraining the university, as defendants, from holding any council meeting without the inclusion of the alumni pending the hearing and determination of the substantive matter before the court.

The alumni association also sought an order restraining the university from unlawfully withdrawing monies from all the banks used in the collections of the alumni fund.

They alleged that over N31 million have been diverted for other purposes from the alumni fund.

Suit no AYHC/03/2023 filed by the Prince Audu Abubakar University Alumni Association came up for its first hearing before Justice F. Ajayi on Friday.

Defence counsel, F.O. Ekpa Esq applied to the court to file a motion on notice for an extension of time within which to file the defendant’s counter-affidavit which was granted by the court.

On the substantive matter against the defendant, F.O Ekpa Esq also applied to the court to grant relief to file the defendant’s memorandum of conditional appearance and statements of defence which was filled out of time. It was also granted by the court.

The defendant, however, filed a motion of preliminary objection challenging the competency of the claimant before the court.

The case was adjourned to May 3, 2023, for a hearing as the court ordered the claimant’s counsel, Ibrahim Shuaibu Esq, to respond to the said notice of preliminary objection formally.
