The Court of Appeal, Abuja Division, on Thursday, dismissed an appeal by Chief Edozie Njoku and Chinedu Okoro challenging the judgement of its Kano Division delivered on August 10, which had affirmed Chief Victor Oye as the National Chairman of the All Progressives Grand Alliance.

Ruling on the appeal marked CA/AW/256/ 2021, filed against Barrister Sylvester Ezeokenwa and five others, the appellate court held that the appeal constituted an abuse of the court process.

In a unanimous decision, the court said considering the principle of starre decisis, it was bound by the judgement of the Kano Division of the Appeal Court delivered on August 10, which had affirmed Chief Victor Oye as the National Chairman of the All Progressives Grand Alliance.

Dismissing the appeal, the panel which was led by Justice Jummai Sankey said it lacked the jurisdiction to entertain the suit, because doing so, “will amount to this court sitting on appeal over its own judgement.”

“This appeal is incompetent and is dismissed for want of jurisdiction.
